Safety first and foremost is the most important guiding principle on the water and we suggest all charter guests be conservative in their judgment and actions. All persons on sailing Vessel MR must obey the directions of Sail Lake Macquarie Captain and Crew and all maritime authorities to ensure compliance with all maritime regulations. Set out below are the conditions for engaging in a sailing activity with Sail Lake Macquarie.
QUOTATIONS
Quotes are valid for 14 days. After which they may be subject to price changes.
BOOKINGS
Cannot be confirmed until full payment is received. Prior to conformation of booking, fees may change at any time without notice.
MINIMUM NUMBERS APPLY FOR OUR CRUISES AS FOLLOWS:
Sunset Cruises – there is a minimum of four guests
Bottomless Brunch – there is a minimum of four guests
If the minimum numbers are not met, we will notify you and provide a full refund or offer a reschedule.
CHILDREN:
Our charters are not suitable for children under 6 years of age. We prioritise the safety and enjoyment of all guests, and young children require a level of close supervision that can be challenging in a marine environment. Children 6 years and older are welcome when accompanied by responsible adults.
WET WEATHER/STRONG RAIN POLICY PROCESS:
On days when the weather may pose a challenge to our experiences we will communicate with you during the day of the cruise only (not the day before as forecasts that far out can be very inaccurate and we could end up making the wrong decision).
If we have any concerns about the weather, we will contact you in the morning on the day of the cruise to let you know our thoughts - this may be to cancel or to let you know we are monitoring conditions.
We will let you know if we need to cancel due to strong winds or thunderstorms. We will consider the forecast and the real-time conditions in our decision and consideration is given to ensure you have a good day out.
POSTPONEMENT OR DATE CHANGE
If the Captain decides the charter cannot proceed due to adverse weather conditions there is no charge. Sail Lake Macquarie will reschedule to an agreed upon date, or provide a credit or refund.
POSTPONEMENT BY GUEST
If notice of postponement is given
- Within 48 hours of charter, all monies are payable to Sail Lake Macquarie and not refunded.
- With at least 49 hours or more notice of charter, a 10% postponement fee applies.
CANCELLATION BY GUEST
If notice of the charter cancellation by is given
-Within 48 hours of charter, all monies paid are payable to Sail Lake Macquarie and not refunded.
-With at least 49 hour or more notice of charter, a 10% cancellation fee applies.
Sail Lake Macquarie reserves the right to change or cancel any booking in accordance with operating requirements or circumstances beyond its control. If this occurs we will reschedule to an agreed upon date or provide a credit or refund.
RESPONSIBLE SERVICE OF ALCOHOL
Sail Lake Macquarie is a Licensed venue and abides by Liquor and Gaming NSW rules for the Responsible Service of Alcohol. Intoxicated patrons will not be permitted onboard the vessel.
BYO is permitted onboard, however strictly no hard spirits or red wine. We also ask if alcohol is brought on board please avoid where possible bringing glass bottles.
RESTRICTED AREAS
Hiring of this vessel does not give you access to cabins and some other restricted areas of the vessel, unless with permission of the captain.
CHARTER COURSE
The course to be undertaken during the charter will be determined by the Captain taking into account weather conditions and the safety of guests and crew.
INDEMNITY
The guest agrees to indemnify and hold harmless the Operator and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities (including reasonable legal fees) caused by any negligent act or omission by the guest including:
1 Failure to follow any reasonable direction given by the master or crew.
2 Failure to comply with any of these terms or conditions.
3 Failure to comply with any warning sign.
4 Unreasonable or unsafe behaviour.
5 Wilful misuse of the equipment or facilities of the vessel.
6 Intoxication or the use of prohibited drugs.
7 Any person leaving the vessel to enter the water does so at their own risk.
8 Any person trying to re board the vessel from the water does so at their own risk.
9 If you choose to leave the vessel we hold no responsibility whilst you are in the water.
RISK WARNING
There are inherent risks and dangers on board any vessel. All passengers participate in the Charter entirely at their own risk.
ACCEPTANCE
The guest agrees to be bound by these Terms and Conditions.
The guest acknowledges that he or she has read and understood these Terms and Conditions.
Occupancy:
Maximum occupancy of the vessel is the number of guests on the booking.
Damage:
Guests are responsible for any damage to the vessel or property during their charter.
Safety & Security:
Sail Lake Macquarie has security measures in place for the safety of its guests.
Guests are advised to follow safety guidelines and instructions provided by the staff.
Pets:
No Pets are not allowed on the vessel.
Shoes:
Sail Lake Macquarie operates a bare foot vessel. Wearing of shoes is not permitted.
Noise & Conduct:
Guests are expected to maintain a reasonable level of noise and conduct during their charter.
Disruptive behaviour may result in eviction from the vessel and the marina without a refund.
Smoking:
Smoking is prohibited anywhere on the vessel.
Liability:
Sail Lake Macquarie is not liable for any loss or damage to personal property during the guest's charter.
The operator is not liable for any injury or accident that occurs on the premises, unless caused by the operators negligence.
Luggage
Please avoid hard luggage bags as these may damage the vessel.
